POLST UPDATE
AB 3000 (Wolk),
which would establish POLST in California, has been amended as
follows:
-
Recognizes that
physicians can always do a "real time" assessment and issue
a new order;
-
Provides an
exception from following the form in the case of medically
ineffective care or care inconsistent with generally
accepted practices;
-
Clarifies that
California has only one POLST form;
-
States that in
the case of conflicting expressions of the patient's wishes
then the most recent expression governs to the extent of the
conflict; and
-
Clarifies that
POLST is not an advance directive.
AB 3000 was passed by the full Senate on July 10 and was passed
by the Assembly on concurrence with a vote of 73-0. It will now
go to Governor for his signature.
